Insolvency Support Services can provide robust and detailed checklists, compliant with the Insolvency (Scotland) Rules 2018, for the following Scottish case types:

  • Administration (SADM)
  • Court Liquidation (SWUC)
  • Creditors' Voluntary Liquidation (SCVL)
  • Members' Voluntary Liquidation (SMVL)

The Scottish Rules, introduced in 2019, brought about process changes to Court Liquidation (SWUC) Creditors and Members Voluntary Liquidation (SCVL and SMVL) and Administration (SADM).  Some of the changes to SCVL and SMVL ensure that the process in Scotland mirrors the England & Wales Rules, but crucially, the remuneration approval process in Scotland for insolvent liquidations, and to an extent SADM, remains the same in structure, although there are amendments to how it applies. There are myriad other changes that need to be incorporated into your checklists and document packs.

If you are buying a checklist in conjunction with a document pack, the checklist will be referenced to our standard document pack. Checklists (and document packs) can be coded for use with Turnkey’s IPS system. Alternatively your in-house document pack can be referenced to our standard checklist.

Investigation and CDDA Checklist

Our Investigation and CDDA checklist is intended for use by insolvency practitioners and their staff dealing with investigations into company director conduct, recovery and disqualification. Applying across insolvent liquidation, administration and receivership, the checklist reflects current insolvency legislation, including the Company Directors Disqualification Act (CDDA), and all statutory references are hyperlinked to the relevant sections.

Cost: £550 excluding VAT.

There are two supporting online training sessions: Pre-appointment advice to directors and SIP 2 and Investigations into Conduct. Costs are £55 excluding VAT per participant.  One single use registration of each online session will be included with the purchase of the checklist.  For two or more registrations to each session, please speak to us directly.

 

Ethics Checklist

Our Ethics checklist is intended to assist insolvency practitioners and their staff considering the ethical issues and considerations before and throughout the period of appointment. Designed to reflect the requirements of the Insolvency Code of Ethics, the checklist is sufficiently detailed to lead you through the pre-appointment considerations and risks, while allowing you the opportunity to document your thoughts and decisions on the ethical issues the case presents.

Cost: £550 excluding VAT.

Moratorium Checklist

The Corporate Insolvency and Governance Act 2020 came into effect on 26 June 2020, being the UK Government’s response to the impact of coronavirus on business. It introduced permanent new solutions for businesses facing financial difficulty, including a new moratorium procedure for use pre-CVA or restructuring, or as a standalone opportunity for a company to rectify its financial position.

Insolvency Support Services’ Moratorium Checklist is split into six sections and this comprehensive work programme sets out the process for obtaining a moratorium, actions on appointment, monitoring the company’s affairs, termination, extension and exit. Requirements are clearly delineated as the responsibility of the monitor or the directors and matters for consideration throughout the moratorium period are set out in detail. As with all our checklists, it is hyperlinked to the relevant statutory provision or guidance.
